TERMS & CONDITIONS
Definition and Scope

These Terms apply whenever Goods or Services are quoted for, sold, supplied, delivered and installed by Ikon Management Group to a Customer.

“Customer" means the customer placing an order and any agent or representative of that customer.
Acceptance

Requesting or accepting a Quotation, placing an Order with or accepting a supply or Delivery of Goods or Services from Ikon Management Group by a Customer constitutes acceptance by the Customer of these Terms and Conditions.

Placement of an order by the Customer, either verbally or in writing, with the Supplier will constitute acceptance of the Supplier’s offer and of these terms and conditions.

To the extent permitted by Law, it is a condition of the Quotation, sale, supply and Delivery of Goods and Services by Ikon Management Group to a Customer that the Customer accepts that these Terms apply as provided in Clause 3, regardless of the provisions of any other document or instruction or/ and of oral understanding between the Customer, including any purchase order terms subsequently given to by Ikon Management Group to the Customer

Any quotation or price information made available by Ikon Management Group is without obligation and subject to change without notice unless an offer has been designated as binding.

As permitted by law, Ikon Management Group reserves the right to correct errors in its offers, invoices, and communications such as spelling or arithmetical errors.

The Customer agrees that Ikon Management Group may amend these terms and conditions at any time. If Ikon Management Group makes a change to these terms and conditions, then that change will take effect from the date on which Ikon Management Group notifies the Customer of such change. The Customer will be taken to have accepted such changes if the Customer makes contact with Ikon Management Group to provide services including but not limited to Materials/Equipment/ installation.

Any time or date of delivery or installation that has been provided by Ikon Management Group to the Customer is an estimate only. The Customer must still accept delivery of the Materials/Equipment/Installation even if late and Ikon Management Group will not be liable for any loss or damage incurred by the Customer as a result of the delivery being late.

Ikon Management Group reserves the right to refuse work or cancel pending work under this clause, Ikon Management Group may refund deposit only if the customer had no fault/ blame or negligence in the cancelation of the work.

Only with the exception of Clause 10, All deposits paid to Ikon Management Group are non-refundable.

If Ikon Management Group is not satisfied as to the Customer's ability to pay for the Goods and/or services, it may suspend or terminate supply and shall not be liable for any claim, damage, loss, expense or cost arising therefrom and all monies then outstanding by the Customer shall immediately become due and payable.

For any goods ordered and later cancelled the Customer shall pay the Ikon Management Group all expenses incurred up to the time of cancellation. The statement of expenses shall be final and binding on the customer.

The Customer acknowledges that in the event of cancelation of the job, the statement of expense will include a 30 percent fee of the total estimate of the work.

The customer undertakes to pay for any additional material used in the process of providing the service by Ikon Management Group.

The Customer is responsible for providing suitable, clear, free and safe access for Ikon Management Group delivery vehicle and Company agents and contractors at all times to enable them to undertake their work. In addition, the Customer agrees to indemnify the Company and its agents and contractors for all damage and injury to any person and to any public or private property, which may result, including any costs associated with enabling the delivery vehicle to leave the site, and the cost of any returned product as a result of the Customer failing to provide suitable and safe access to the delivery site.

Ikon Management Group shall not be liable for any loss or damage to the site, including without limitation, damage to pathways, driveways and concrete or paved or grassed areas.

The customer agrees to indemnify the Ikon Management Group against any liability Ikon Management Group may incur as a result of the failure of the customer to follow generally accepted good practice, or due to a lack of ability, expertise, or skill with the particular type of goods when they are being installed.

The customer is solely responsible to provide an uninterpreted supply of water and power for Ikon Management Group at all times to enable them to undertake their work. In addition to bearing cost of the uninterpreted water and power supply the Customer agrees to indemnify the Company and its agents and contractors for all damage and injury to any person and to any public or private property, which may result due to the water or power supply provided and also in the event of Customer failing to provide suitable and safe access to power and water.

The Customer undertakes to pay half the payment on the first day of preparation of the work to be undertaken.

Failure to provide half the payment on the first day may include consequence but not limited to the stated consequence, such as an extension of the completion/ delivery date or cancelation of the work by for Ikon Management Group. Ikon Management Group is not to be liable for any claim, damage, loss, expense or cost arising therefrom and all monies then outstanding by the Customer shall immediately become due and payable.
